Terms and conditions
These terms apply when you use digitorium.in and when you hire us. By using the site or accepting a quote from us, you agree to them. Where a written quote or agreement signed by both of us says something different, that document wins for that project.
1. About us
"Digitorium", "we" and "us" mean Digitorium, a sole proprietorship of Neel Surti, at 10 Mangalmay Complex, Maninagar, Ahmedabad, Gujarat 380008, India. "You" means the person or business using the site or hiring us. Contact: info@digitorium.in or +91 786 198 2524.
2. Our services
We offer web design and development, custom software, Meta and Google ads, SEO, photo and video shoots, and branding and design. The exact work, deliverables, timeline and price for your project are set out in a written quote we send you by email or WhatsApp. Anything not listed in the quote is not included, and we will quote separately for it before starting.
3. Quotes and payment
- Every project starts with a written quote. A quote is valid for 30 days unless it says otherwise.
- We take an advance before work starts. The advance amount is stated in your quote. Work begins once it is received.
- The balance is due as set out in the quote, and before we hand over final files, publish a website or transfer accounts.
- Monthly services, such as ads management and SEO, are billed in advance for each month.
- Digitorium is not registered for GST, so our invoices do not include GST. If we register in future, GST will be added as the law requires and shown on the invoice.
- If a payment is late, we may pause the work until it is received. Timelines move by the length of the pause.
4. No refunds
All payments, including the advance, are non-refundable. This applies if you cancel the project, change your mind, or stop replying partway through. The advance reserves our time and covers work that starts as soon as you pay it. If you have paid for a monthly service, we will complete that month and not bill the next.
Nothing in these terms takes away any right you have under Indian law that cannot be excluded by agreement.
5. Your part
- Give us the content, logins, approvals and feedback we need, on time. Delays on your side move the timeline.
- Make sure you have the right to use everything you send us, such as logos, photos, text and music, and that it does not break any law.
- Check your website, ads and other work before approving it. Once you approve something, later changes count as new work.
- The number of revision rounds is stated in your quote. Extra rounds are charged separately.
6. Ads and ad spend
Ad spend is separate from our fee. You pay Meta and Google directly from your own ad account, and you control the budget. Ads must follow Meta's and Google's advertising policies. These platforms can reject ads, limit reach or restrict accounts under their own rules, and we cannot control or reverse their decisions.
7. No guaranteed results
We do the work carefully and report honestly, but we do not guarantee a specific number of leads, sales, bookings, followers or search rankings. Results depend on your market, your offer, your budget, how you follow up with leads, and platforms we do not control. Figures in our case studies describe what happened for those clients. They are not a promise of the same result for you.
8. Third-party platforms
Websites, domains, hosting, email, WhatsApp, Meta, Google and similar services are run by other companies under their own terms and prices. Where possible they are registered in your name and paid by you. We are not responsible for their outages, price changes, policy changes or account decisions.
9. Who owns the work
- Once you have paid in full, you own the final deliverables we made specifically for you, such as your website design, logo, photos, videos and ad creatives.
- Until you have paid in full, the work remains ours, and we may take down or withhold anything not yet paid for.
- We keep ownership of our own tools, code libraries, templates and methods that we used to make your work. You get a permanent right to use them as part of your deliverables.
- Fonts, stock media, plugins and software from other companies stay under their own licences.
- With your permission, we may show the work in our portfolio and case studies.
10. Confidentiality
We keep your business information, logins, customer data and numbers private, and use them only to do your work. We will not share them unless you allow it or the law requires it. How we handle personal data is explained in our Privacy Policy.
11. Ending a project
Either of us can end a project or a monthly service by telling the other in writing, by email or WhatsApp. You pay for the work done up to that point, and payments already made are not refunded (see section 4). On ending, we will return your logins and hand over the work you have paid for.
12. Limit of liability
As far as the law allows, our total liability for any claim about a project is limited to the fees you paid us for that project, or for monthly services, the fees you paid in the three months before the claim. We are not liable for indirect losses such as lost profit, lost business or lost data, or for losses caused by third-party platforms.
13. Using this website
The content on digitorium.in is for general information about our services. Do not copy it, misuse the site, try to break its security, or send false details through our forms. Links to other websites are for convenience and we are not responsible for their content.
14. Governing law
These terms are governed by the laws of India. Any dispute will first be discussed in good faith. If it cannot be settled, the courts at Ahmedabad, Gujarat will have exclusive jurisdiction.
15. Changes and contact
